It was a mild drama last week at Lagos High court when counsels involved in Asa’s lesbianism case engaged in a heated argument.
On
one side are Asa’s lawyers who are desperate to withdraw their suit and
on the other hand is the defendant’s lawyer who is bent in pursuing the
case to a logical conclusion before the honourable court.
The
bone of contention began when Lawyers to Bukola Elemide popularly known
as ASA made an application before Justice Coker to withdraw their 700
million suit against News of the People magazine.
According to her lawyers from Abraham Chambers,
the application was brought as they could not produce witness to
support their case, hence the application asking the court to quash the
case.
In
a swift reaction however, the defendant’s lawyer, Yinka Muyiwa urged
the court to dismiss the application, saying the case has gone far
beyond a stage they can withdraw.
His
argument was that the plaintiff (Asa) ought to have realized from the
beginning of the case and withdraw the case rather than wait till last
minute after several resources have been expended in sufficient quantity
adding ‘before you come to the court, you must have prepared for the
case and when you are not prepared, you rather don’t come’
He however pleaded with the court to go ahead with its judgment on the case.
The honourable Justice Coker however adjourned the case for ruling on the application for three weeks
It
would be recalled that on three different occasions, Asa’s lawyers have
to change witnesses as they refused to appear one after the other.
Asa had approached the court in 2011 to claim damages of 700 million naira over a story titled ‘Asa In Lesbianism Scandal’
